The NSPS OOOOb initial compliance deadline is May 7, 2024.
With this deadline fast approaching, affected facilities are competing for limited resources, and many operators have expressed concern related to the net heating value (NHV) sampling analysis for flares and enclosed combustion devices (ECD).
At a minimum, this analysis requires a 14-day sampling effort, while the intermittent nature of flaring events threatens to extend the sampling timeline.
Applying for a Compliance Deadline Extension
If you have immediate concerns about the deadline, consider applying for an extension. While OOOOb does not explicitly mention extensions, the General Provisions under 40 CFR 60, Subpart A provide a compliance extension pathway for instances of force majeure. Claims of force majeure require events or circumstances beyond the control of the owner/operator or its contractors, and any such request must be submitted “as soon as practicable” once the need for an extension becomes apparent.
